2. Collection and storage of personal data as well as the type and purpose of their use

a) When visiting the website

When accessing our website https://qatsol.com/, the browser used on your device automatically sends information to the server of our website. This information is temporarily stored in what is called a log file. The following information is collected without your intervention and stored until automatic deletion:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the accessed file,
  • Website from which the access occurred (referrer URL),
  • The browser used and possibly the operating system of your computer as well as the name of your access provider.

The aforementioned data are processed by us for the following purposes:

  • Ensuring a smooth connection to the website,
  • Ensuring comfortable use of our website,
  • Evaluation of system security and stability, and
  • For further administrative purposes.

The legal basis for data processing is Art. 6 Para. 1 S. 1 lit. f GDPR. Our legitimate interest follows the purposes listed above for data collection. We never use the collected data for the purpose of drawing conclusions about your person.

In addition, we use cookies and analytical services during your visit to our website. Further explanations can be found under nos. 4 and 5 of this privacy policy.

b) When registering for our newsletter

If you have expressly consented according to Art. 6 Para. 1 S. 1 lit. a GDPR, we use your email address to regularly send you our newsletter. For the receipt of the newsletter, the provision of an email address is sufficient.

You can unsubscribe at any time, for example, via a link at the end of every newsletter. Alternatively, you may also send your unsubscribe request at any time to aal@qatsol.com.

c) When using our contact form

For any kind of questions, we offer you the opportunity to contact us via a form provided on the website. It is required to provide a valid email address so that we can respond to you. Further information can be provided voluntarily.

Data processing for the purpose of contacting us takes place according to Art. 6 Para. 1 S. 1 lit. a GDPR based on your voluntarily given consent.

The personal data we collect for using the contact form will be automatically deleted after your request has been dealt with.

3. Data Sharing

Your personal data is not transferred to third parties for any purposes other than those listed below.

We only share your personal data with third parties if:

  • You have given your express consent to do so according to Art. 6 Abs. 1 S. 1 lit. a GDPR,
  • The transfer is necessary according to Art. 6 Abs. 1 S. 1 lit. f GDPR for the establishment, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
  • There is a legal obligation for the transfer according to Art. 6 Abs. 1 S. 1 lit. c GDPR, and
  • The transfer is legally permissible and necessary for the settlement of contractual relationships with you according to Art. 6 Abs. 1 S. 1 lit. b GDPR.

4. Cookies

We use cookies on our site. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not cause any damage to your device, do not contain viruses, trojans or other malware.

The cookie stores information which results in connection with the specific device used. However, this does not mean that we directly obtain knowledge of your identity.

The use of cookies serves on the one hand to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically deleted after you leave our site.

Furthermore, we also use temporary cookies to optimize user-friendliness, which are stored on your device for a specific period. If you revisit our site to use our services, it is automatically recognized that you have already been with us and which inputs and settings you have made, so you do not have to re-enter them.

5. Analysis Tools

a) Tracking Tools

The tracking measures listed below and used by us are carried out on the basis of Art. 6 Abs. 1 S. 1 lit. f GDPR. With the tracking measures we use, we aim to ensure a design tailored to needs and continuous optimization of our website. On the other hand, we use tracking measures to statistically record the usage of our website and to evaluate it for the purpose of optimizing our offer for you. These interests are considered legitimate within the meaning of the aforementioned provision.

The respective data processing purposes and data categories can be found in the corresponding tracking tools.

b) Google Analytics¹

For the purpose of designing and continuously optimizing our pages to meet user demand, we use Google Analytics, a web analytics service provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). In this context, pseudonymized user profiles are created and cookies (see no. 4) are used. The information generated by the cookie about your use of this website such as

  • Browser type/version,
  • Operating system used,
  • Referrer URL (the previously visited page),
  • Hostname of the accessing computer (IP address),
  • Time of the server request,

are transferred to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on website activity, and to provide other services related to the use of the website and the internet for market research purposes and the need-based design of these internet pages. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of Google. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymized, so that an assignment is not possible (IP masking).

You may refuse the use of cookies by selecting the appropriate settings on your browser; however, please note that if you do this, you may not be able to use the full functionality of this website.

Furthermore, you can prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of these data by Google by downloading and installing a browser add-on.

Alternatively to the browser add-on, especially for browsers on mobile devices, you can also prevent data collection by Google Analytics by clicking [ga-optout text=”Disable Google Analytics”]. An opt-out cookie will be set to prevent the future collection of your data when visiting this website. c) Google AdWords Conversion Tracking

To statistically record the usage of our website and to evaluate the optimization of our website for you, we also use Google Conversion Tracking. Google AdWords places a cookie on your computer (see item 4), provided you reached our website via a Google ad.

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of the AdWords customer’s website and the cookie has not expired, Google and the customer can tell that the user clicked on the ad and was redirected to that page.

Each AdWords customer receives a different cookie. Therefore, cookies cannot be tracked across AdWords customers’ websites. The information obtained with the help of the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers learn the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can personally identify users.

If you do not want to participate in the tracking process, you can also refuse the setting of a cookie required for this purpose – for example by a browser setting that generally disables the automatic setting of cookies. You can also disable cookies for conversion tracking by setting your browser to block cookies from the domain “www.googleadservices.com”. d) Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter referred to as “reCAPTCHA”) on our websites. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

reCAPTCHA is intended to verify whether data entry on our websites (e.g., in a contact form) is done by a human or by an automated program. To this end, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the site. For the analysis, reCAPTCHA evaluates different information (e.g., IP address, duration of the website visitor’s stay on the website, or mouse movements made by the user). The data collected during the analysis are forwarded to Google.

The reCAPTCHA analyses run entirely in the background. Website visitors are not notified that an analysis is taking place.

The data processing is based on Art. 6 (1) lit. f GDPR. The website operator has a legitimate interest in protecting its web offers from abusive automated spying and from SPAM.

e) Matomo

We use the open-source software Matomo for the analysis and statistical evaluation of the use of our website. For this purpose, cookies are used (see item 4). The information generated by the cookie about the use of the website is transferred to our servers and summarized in pseudonymous user profiles. This information is used to evaluate the use of the website and to enable a user-optimized design of our website. There is no transfer of information to third parties.

The IP address is not associated with any other user data under any circumstances. IP addresses are anonymized, making matching impossible (IP masking).

6. Social Media Plug-ins

On the basis of Art. 6 (1) sentence 1 lit. f GDPR, we implement social plug-ins of the social network Facebook on our website to make our firm better known through it. The underlying advertising purpose is considered a legitimate interest within the meaning of the GDPR. The respective providers bear the responsibility for the operation compliant with data protection laws. The integration of these plug-ins by us is done by way of the so-called two-click method to protect visitors of our website as best as possible.

Facebook

Social media plugins from Facebook are employed on our website to make its use more personal. For this purpose, we use the “LIKE” or “SHARE” button. This is a service offered by Facebook.

When you visit a page of our web presence that contains such a plugin, your browser establishes a direct connection with Facebook’s servers. The content of the plugin is transmitted from Facebook directly to your browser and integrated into the website.

Through the integration of plugins, Facebook receives the information that your browser has visited the corresponding page of our web presence, even if you do not have a Facebook account or are currently not logged into Facebook. This information (including your IP address) is sent directly from your browser to a server in the USA and stored there.

If you are logged in to Facebook, Facebook can directly associate the visit to our website with your Facebook account. If you interact with the plugins, for example, click the “LIKE” or “SHARE” button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and shown to your Facebook friends.

Facebook may use this information for the purposes of advertising, market research, and the demand-oriented design of Facebook pages. To this end, Facebook creates usage, interest, and relationship profiles, e.g., to evaluate your use of our website with regard to the advertisements that are shown to you on Facebook, to inform other Facebook users about your activities on our website, and to provide further services associated with the use of Facebook.

If you do not want Facebook to attribute the data collected through our web presence to your Facebook account, you must log out of Facebook before visiting our website.

7. Rights of Data Subjects

You have the right:

  • in accordance with Art. 15 GDPR, to request information about your personal data that we process. Specifically, you may request information about the purposes of processing, the categories of personal data concerned, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing, or objection, the existence of a right to lodge a complaint, the source of your data if not collected from us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information on the details of such processing;
  • in accordance with Art. 16 GDPR, to demand the immediate correction of incorrect or complete your personal data stored by us;
  • in accordance with Art. 17 GDPR, to demand the deletion of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for public interest reasons or for asserting, exercising or defending legal claims;
  • in accordance with Art. 18 GDPR, to demand restriction of processing of your personal data, insofar as the accuracy of the data is contested by you, the processing is unlawful, but you refuse its deletion and we no longer need the data, but you require them for asserting, exercising or defending legal claims, or you have objected to the processing pursuant to Art. 21 GDPR;
  • in accordance with Art. 20 GDPR, to receive your personal data which you have provided us in a structured, commonly used and machine-readable format or to request the transfer to another controller;
  • in accordance with Art. 7 para. 3 GDPR, to revoke your once given consent to us at any time. This means that we may no longer continue the data processing that was based on this consent for the future; and
  • in accordance with Art. 77 GDPR, to lodge a complaint with a supervisory authority. Typically, you can contact the supervisory authority of your habitual residence, place of work or our office headquarters.

8. Right to Object

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right pursuant to Art. 21 GDPR to object to the processing of your personal data, provided there are reasons arising from your particular situation, or the objection is directed against direct marketing. In the latter case, you have a general right to object, which we shall implement without stating a particular situation.

9. Data Security

We use the widely accepted SSL (Secure Socket Layer) procedure in conjunction with the highest level of encryption supported by your browser during website visits. This usually involves a 256-bit encryption. If your browser does not support 256-bit encryption, we will instead use 128-bit v3 technology. You can tell whether a single page of our website is transmitted encrypted by the closed representation of the key or padlock icon in the lower status bar of your browser.

In addition, we employ appropriate technical and organizational security measures to protect your data against accidental or intentional manipulations, partial or complete loss, destruction, or against unauthorized access by third parties. Our security measures are continuously improved in line with technological development.

10. Currency and Amendment of this Privacy Policy

This privacy policy is currently valid and was last updated in May 2018.
